Coauthors: Senators DeSaulnier and Florez As introduced, AB 243 would  amend Penal Code Section 597.1, enacted as a mandate rather than county elected option with the 1997 Hayden bill, SB 1785, to delete a paragraph covering post- adjudication provisions and enact a new Penal Code Section 597.8 (would require re-numbering if this and AB 241 both enacted) to mandate a number of post-conviction (designated offenses) restrictions on owning or caring for animals, classified as ´contempt of court¡ as misdemeanor offenses and forfeiture of any animals involved.  This would remove all judicial discretion as to these post-conviction issues, and as introduced, deletes the provisions for return or disposition of animals following acquittal or non-conviction.

As introduced, AB 1122  would add a new Penal Code Section 597.4 making it "unlawful for any person to willfully sell, trade, barter, display, or offer for sale, trade, or barter, or give away as part of a commercial transaction a live animal on any street, highway, public right-of-way, commercial parking lot, or at any outdoor special sale, swap meet, flea market, parking lot sale, carnival, or boardwalk" except ag auctions/sales, tax-exempt SPCAs (statutory restriction would apply, i.e.not merely tax exempt), and public animal control agencies.  Violations range from $250 infraction for 1st offense w/o harm to animal and misdemeanors for 1st offence w/harm, or subsequent offenses, fine up to 1k, court to weigh gravity in determining fine level.  All other laws apply additionally.

LAAS Spay/Neuter Advisory Committee Recommendations

  • Reduce 1st - 3rd Notice to Comply timeframe from 180 down to 120 days (by reducing the 2nd and 3rd notices down to 30 days from 60 days)
  • Enforcement priorities should be established - include leash law violations (these priorities not established at this time)
  • Require s/n of any intact animal reclaimed upon second inpoundment even if they are owner has Breeder Permit for them (currently owner can reclaim by paying "added penalties" for unneutered animal multiple times if they have breeder permit)
  • Raise price of breeding permit AND deny a breeding permit to ANYONE who has received a "notice to comply"
  • Raise standards to obtain a Breeder Permit, which they recommend to include temperament testing, OFA certification and other health requirements, and earning of titles
  • Change s/n exemption to require dog be shown in one show in past ONE year (currently one show in past two years)since dogs also should be trained for performance activity, as guide or service dog, or as military dog, to show that this is legitimately being done, they recommend that "trainer" for these dogs must be a licensed business in City of LA as well as meet certain professional "qualifications"
  • Eliminate separate breeder permit - if owner to be allowed to breed, must first obtain a s/n ordinance exemption (see above changes that would be required.)

Problem:
It is not clear how and why these registries and associations were approved, based on the fact that none of these organizations has any standards for involvement, except a registration fee. The approved registries and associations are summarized below the Committee’s recommendation.

Recommendation

Registries should be investigated and found to have standards for registry protecting the health of animals to be bred and the offspring before approval is granted.

What does it mean to be involved? When negative legislation is proposed or adopted, it affects and alters the time and energy devoted to positive events as efforts are diverted to protecting our freedoms and those of our animals. It is extremely important to halt the negative influences of animal rights organizations so that energy can be devoted to all the beneficial effects that our animals can bring, such as having events that promote responsible dog ownership, etc. like showing our communities the countless types of work that our dogs are capable of doing.
